ROBBERY (Penal Code 211)

Robbery & burglary are terms often used interchangeably by laypersons. Robbery, however, differs basically from burglary, because force against a person is involved. It is the felonious taking of property from another person, against his will, by use of force or fear. Burglary, on the other hand (Penal Code 459),is entering of the dwelling of another with the intent to take property belonging to another. If the dwelling is occupied at the time, it is a first degree burglary charge. ( If the person inside the dwelling is threatened by the perpetrator, it is also a robbery). All non-occupied dwellings that are entered for that purpose are second degree burglaries.
