KIDNAPPING (Penal Code 207)
Kidnapping is generally defined as the detention, either by force, fear, holding or detaining, any person against their will. It is also a crime of kidnapping to persuade or entice, either by false promises or misrepresentation, any child under the age of 14 to leave the county or state or country.
Kidnapping charges with force or violence carry much stiffer sentences, and kidnapping during the commission of a carjacking can carry a life prison term ( P.C. 209.5). All kidnapping charges (even by a parent against a court order) are to be taken extremely seriously.
