Airline injuries
An airline’s liability to passengers for injuries is governed by the type of flight – national or international. In the absence of a specific statute, “common carriers” such as airlines have the duty to use the utmost care and highest degree of diligence in handling passengers. However, if an airline decides a passenger is unruly, and decides to eject him, their duty is modified. They are required to use “reasonable care” in ejecting passengers in national flights. If the flight is international, the Warsaw and Tokyo Conventions apply, and their standards are also based on a “reasonable” standard, EID v. Alaska Airlines , 8/2/10
